These Terms of Service are a binding agreement between you and Historic Coast Handy Men ("we", "us"). They apply when you use historiccoasthandymen.com, request a quote, book or receive our handyman or junk removal services, join a home care plan, or pay us. By doing any of those things you agree to these terms and to our Privacy Policy. If you do not agree, do not use the site or our services.

1. Who can use our services

You must be at least 18 and able to enter a contract. You confirm that you own the home or have the authority to let us in and to approve the work, and, for junk removal, to have the items removed. If you book for someone else, such as a tenant, landlord, owner or estate, you confirm you are authorized to act for them and you agree to these terms on their behalf as well as your own. If your home is in a condo or a community with an association, you are responsible for any approval its rules require for the work, and we follow the building's rules while we are there.

2. What we do and do not do

We do work that Florida does not require a contractor license for: painting, residential drywall repair, mounting, assembly, caulking and weatherproofing, lock and hardware replacement, tile repair, fence, screen and trim repair and similar jobs. We do not do electrical work of any size, plumbing, heating and air conditioning, roofing, structural work, door or window installation, condo flooring, or any work that needs a building permit. We are not a licensed contractor. If a job turns out to need a licensed trade, we stop and tell you.

  • We mount TVs and hide cords in a surface cover, but we never run power or cable inside walls.
  • On sliding glass doors we do repairs only: cleaning the track, adjusting or replacing the rollers, and replacing handles, latches and screen door rollers. We never replace glass, tracks or frames, and we do not install new doors.
  • We do not disconnect appliances, water heaters or hot tubs from power, water or gas, and we do no demolition.
  • Our techs will not take on work outside this scope, even if asked on the day.

3. Estimates and prices

The instant quote is an estimate from our published rate card: the labour time for each job you pick at our hourly rate, a minimum visit, and a half-day or full-day rate when that is cheaper. Labour after the first hour is counted in half-hour steps, and heavy pieces that need two of us are priced at our two-person rate. Junk removal is priced per item or by the trailer load. We confirm the list and the price before work starts. If a job turns out bigger than listed, we tell you and you decide before we continue.

Homes outside our core service area may carry a travel adjustment, which the quote shows. We may correct an obvious pricing error before the work begins. Sales tax is added where Florida law requires it.

4. Materials

Materials are not in the labour price. We buy what the job needs and bill it at cost plus 20%, itemized with receipts, or you supply them. We ask before buying anything over $100. Materials and products, whether we buy them or you supply them, carry their makers' warranties, not ours (section 13). If you supply them, you are responsible for their being right for the job and complete.

5. Scheduling and arrival

Arrival times are estimates. Traffic, weather and earlier jobs can affect when we arrive, and we will let you know if we are running late. Some jobs need more than one visit, such as large drywall patches that must dry between coats; when that is the case, the quote includes it.

6. Changes and cancellations

  • You may move or cancel a visit at no charge with at least 24 hours notice. If something comes up with less notice, tell us as soon as you can.
  • A lockout, where we arrive and cannot get in because no one lets us in or the codes or keys do not work, may be billed as the minimum visit.
  • We may reschedule because of weather, storms, hurricane watches and warnings, emergencies or illness. We will tell you as soon as we can and will not charge you for a visit we move.

7. Your responsibilities

  • Give us safe access at the agreed time, with working power and water where the job needs them.
  • Put away or secure cash, jewelry, firearms, medications, important papers and anything irreplaceable or of sentimental value.
  • Tell us about anything that needs special care before we start, such as natural stone, antiques, art or delicate fixtures, and about anything loose, broken or unstable.
  • Tell us where you know wires, pipes or other lines run inside the walls, floors or ceilings we will work on. We check before we drill or cut, but we cannot see inside them.
  • Tell us about known hazards, including mold, pests, asbestos, lead paint, biohazards or structural problems.
  • Keep pets secured or tell us how they should be handled. If pets are left loose, you accept the risk that a pet may get out while we come and go.
  • Provide a respectful, safe place to work. We may decline or stop work, and leave, if anyone is threatening, harassing or unsafe, or if conditions put our team at risk. The visit is then invoiced for the time already spent, never less than the minimum visit, plus any materials already bought.

8. Junk removal and haul-away

  • Hauling only. We load and haul what you have already set aside or taken apart. We do no demolition and tear nothing out. Appliances, water heaters and hot tubs must already be disconnected from power, water and gas by a licensed professional before we arrive, and water heaters drained. Once a hot tub is disconnected, we break it down on site to haul it away.
  • Authority. You confirm that you own the items or have the right to have them removed and disposed of.
  • Check before loading. Once items are loaded, they become ours to dispose of and cannot be returned. Please remove anything you want to keep, including from drawers, boxes, bags and containers. We do not search contents.
  • What we do not take: paint, fuel, oil, solvents, chemicals, pesticides, tires, propane or other gas tanks, batteries other than household batteries, asbestos, medical waste, ammunition, explosives, other hazardous waste, and anything we are not permitted to transport. We may refuse any item we believe is unsafe or not allowed.
  • Price. The quote prices common items one by one and larger piles by the trailer load. The final price is confirmed on site before anything goes on the trailer, and items added on the day are priced before they are loaded. Heavy material such as concrete, tile, dirt and shingles is priced by the load and must already be loose. Loading, hauling and disposal fees are included in the price.
  • Disposal. We choose how items are disposed of, which may include landfill, transfer station, recycling or donation. We do not promise that any item will be donated or provide donation receipts.
  • Access and property. Clear a path to the items and tell us about soft ground, septic systems, sprinkler heads, low branches and anything buried near where our vehicle and trailer will go. We are not responsible for damage to driveways, curbs, lawns or landscaping from normal vehicle access along the route you approve, or for damage to buried lines, pipes or other items that were not marked or disclosed.

9. Home care plans

A plan books a visit of the plan's length every month or every three months at the plan rate. It is prepaid labour time only: it does not cover the cost of repairing or replacing anything, and it is not a warranty or insurance. Unused time does not roll over. Cancel any time before the next visit by emailing hello@historiccoasthandymen.com or telling us.

  • Materials used on a plan visit are billed as described in section 4.
  • Plan visits follow these terms like any other visit, including the scope in section 2.
  • A plan visit you move with at least 24 hours notice is rescheduled. A plan visit you skip is not credited, because unused time does not roll over. A visit we cancel is rescheduled, or credited on a later invoice.
  • We will give you at least 30 days notice before changing your plan rate or monthly amount, and you may cancel before the change takes effect.

10. Monthly billing for plans

  • Instead of an invoice after each visit, a plan can be billed as one fixed amount on the plan's billing day each month, in advance, for that calendar month. Individual visits on the plan are then not invoiced.
  • The monthly amount spreads the cost of the plan's visits evenly across the months, so it stays the same every month, including months with no visit on a plan with a visit every three months.
  • When you cancel the plan, you will not be billed again.

11. Payment

  • Each visit is invoiced when it is finished, and payment is due on receipt. A plan can instead be billed monthly, as section 10 explains.
  • You can pay by card through the secure invoice link or your client account page, or by check or cash. Card payments are processed by Stripe, and we never see or store your full card number.
  • A returned check may be charged the service fee Florida law allows.
  • If an invoice is past due, we may pause your visits until it is paid. You agree to pay reasonable costs of collection, including attorney's fees, to the extent the law allows.
  • If you believe a charge is wrong, tell us within 60 days of the invoice. Please contact us before disputing a charge with your card issuer, so we can resolve it quickly.

12. Automatic payments and saved cards

  • Automatic payments are optional and available for plans billed monthly. You turn them on by ticking the authorization box when you pay an invoice. That saves your card with Stripe, on your customer record there; we keep only its last four digits, brand and expiration date, together with a record of the authorization you gave, when, and from which IP address.
  • By turning them on, you authorize us to charge the saved card on each billing day for your plan's monthly amount plus applicable sales tax, until you turn automatic payments off.
  • You receive an invoice for every charge.
  • You can turn automatic payments off at any time from your client account page or by emailing us. Doing so removes the saved card and switches the plan back to invoices with a payment link. It does not cancel the plan.
  • If a charge is declined, the invoice stays open with its payment link and we try the card once more three days later. Please keep your card details current.

13. Our 30-day workmanship guarantee

If our workmanship is not right, tell us within 30 days of the visit and we come back and fix it at no charge. This covers our labour, not products or materials, which carry their makers' warranties. A return visit to fix our work is the remedy under this guarantee. It does not cover work we did not do, damage or wear that happens after we leave, changes made by others, or problems caused by hidden conditions we could not reasonably have seen.

14. Property and damage claims

We take care in every home. If you believe we damaged or lost something, report the claim to us in writing within 48 hours of the visit, with photos, and keep the item so we can inspect it. If the damage was caused by our negligence, we will, at our choice, repair the item, replace it, or pay the reasonable repair cost or its actual cash value. Actual cash value means its value at the time, not the cost of a new one and not sentimental value.

We are not responsible for: damage that existed before the visit; normal wear; walls, surfaces or items that were already loose, weakened, damaged or improperly installed; wires, pipes or other lines hidden inside walls, floors or ceilings that were not visible or disclosed to us, where we took reasonable care; results of following your instructions or using materials you supplied; items you did not tell us need special care; cash, jewelry, art, collectibles, heirlooms or documents that were not put away; or loss caused by events outside our reasonable control.

15. Keys, codes and alarms

We keep keys and codes you give us confidential and use them only for your visits. We return keys when you ask or when service ends. You are responsible for your alarm settings and for telling your alarm company that we are authorized. False alarm fees caused by wrong codes or instructions are your responsibility.

16. Photos

Photos you upload with a quote, and before and after photos our techs take on the job, are kept with your quote and job records. We use them to prepare the quote, do the work, check its quality and keep our records. We do not publish photos of your property without asking you first.

17. Using this website

You may use the site for your own personal or business use in dealing with us. You agree not to: enter false information or someone else's details; submit automated or bulk requests; copy, scrape or resell the site's content or pricing; try to get around its security or access areas you are not authorized to use; or interfere with how it works. The site's content, design, name and logos belong to us. Information on the site is provided for general purposes, may change without notice, and may contain errors, which we may correct at any time. Links to other websites are provided for convenience; we are not responsible for their content.

18. Messages you agree to receive

You agree that we may contact you by email, phone and, if you agree to texts, text message about your quotes, visits, invoices and account. You agree that notices, invoices and records may be provided electronically, and that clicking or ticking to accept on the site has the same effect as a signature.

19. Disclaimer of warranties

We will perform our services with reasonable care and skill. Apart from that promise and the guarantee in section 13, and to the fullest extent the law allows, the site and our services are provided "as is", and we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Products and materials carry only their makers' warranties.

20. Limitation of liability

To the fullest extent the law allows: (a) we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or loss of use, even if we were told they were possible; and (b) our total liability for any claim arising out of the site or our services is limited to the amount you paid us for the specific service that gave rise to the claim. Section 14 describes how we handle property damage. Nothing in these terms limits liability for our gross negligence or intentional misconduct, or any liability the law does not allow us to limit.

21. Your responsibility to us

To the extent the law allows, you agree to defend and indemnify us and our team against claims, losses and costs, including reasonable attorney's fees, that arise from your breach of these terms, hazards you did not disclose, items you had us remove that you had no right to dispose of, work you asked us to do at a property you had no authority to approve, your pets, or work done as you instructed.

22. Events outside our control

We are not responsible for delay or failure caused by events beyond our reasonable control, including hurricanes, tropical storms, floods, severe weather, fire, power or utility outages, road closures, government orders, epidemics, labor shortages or supplier failures.

23. Resolving disputes: arbitration, class action waiver and jury waiver

Talk to us first. If you have a dispute with us, email hello@historiccoasthandymen.com with your name, address and a description of the problem and what you want. We will try in good faith to resolve it within 30 days. Neither of us will start arbitration or a lawsuit until that 30 days has passed.

Binding arbitration. Any dispute or claim between you and us arising out of or relating to the site, our services, an invoice, or these terms, that we cannot resolve informally, will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (or its Commercial Arbitration Rules if you book as a business). The arbitrator decides all questions about whether a dispute must be arbitrated, except that a court decides questions about the class action waiver below. Arbitration fees are paid as the AAA's rules provide. The hearing will take place in St. Johns County, Florida, or by phone or video. The arbitrator may award the same individual relief a court could, and judgment on the award may be entered in any court with jurisdiction. The Federal Arbitration Act governs this section.

Exceptions. Either of us may bring an individual claim in small claims court instead of arbitration if it qualifies. Either of us may ask a court to stop misuse of the site or of our name or content.

Class action waiver. You and we each agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective or representative proceeding. If this waiver is found unenforceable for a claim, that claim must proceed in court, not in arbitration.

Opting out. You may opt out of this arbitration agreement by emailing hello@historiccoasthandymen.com within 30 days after you first accept these terms, with your name, service address and a statement that you opt out of arbitration. Opting out does not affect the rest of these terms.

Court and jury waiver. Any dispute not resolved by arbitration will be decided exclusively by the state or federal courts for St. Johns County, Florida, and you and we consent to their jurisdiction. YOU AND WE EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY SUCH DISPUTE.

24. Governing law and attorney's fees

These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules, and by the Federal Arbitration Act for section 23. In any arbitration or lawsuit to enforce these terms, the prevailing party may recover its reasonable attorney's fees and costs.

25. Changes to these terms

We may update these terms. The date at the top shows when they last changed. If you are on a home care plan, we will email you about material changes at least 30 days before they take effect, and you may cancel before then. Using the site or our services after a change takes effect means you accept it. A change to section 23 will not apply to a dispute you have already told us about.

26. General

These terms, together with your confirmed quote or invoice and our Privacy Policy, are the entire agreement between you and us about their subject. If any part is found unenforceable, the rest stays in effect and that part is enforced to the fullest extent allowed. If we do not enforce a right, we have not waived it. You may not transfer your rights under these terms without our consent; we may transfer ours to a successor business. Sections that by their nature should continue after service ends, including payment, the guarantee, damage and claims, limitation of liability, indemnity and dispute resolution, continue. Nothing in these terms limits any right to cancel that a Florida or federal cooling-off law gives you for a purchase agreed to in your home.
